Our decision as to whether to include an artwork in the catalogue raisonné shall be solely an expression of our opinion and shall remain within our sole and absolute discretion. The decision to include an artwork does not constitute a warranty or guarantee as to the artwork’s authenticity or provenance and may not be relied upon as such by you, the owner or any third party. Nor shall a decision not to include an artwork constitute a declaration that it is inauthentic. We reserve the right to change our decision as we see fit at any time. You acknowledge and agree that we are not required to share with you the criteria used in making the decision.
Neither we nor any person associated with us, including but not limited to members of our review committee, writers, researchers, advisors, consultants, the CARMEN HERRERA FOUNDATION, and any individuals or entities providing any of our funding, warrants or guarantees the correctness of our opinions and decisions.
We expressly disclaim all liability for damages of any kind relating to or arising from any decision by us to include or not include your artwork in the catalogue raisonné including specifically damages relating to the value of the artwork.
By submitting an artwork for our consideration, you warrant and represent that you are the owner of the artwork in question or if not the authorized representative of the owner and that you have provided us with all information in your possession relating to the artwork, including its provenance and exhibition history, which is to the best of your knowledge accurate and complete.
By submitting an artwork for our consideration, you knowingly and voluntarily waive all claims against us, the CARMEN HERRERA FOUNDATION, and any person or entity that may have contributed in any manner to the preparation of the catalogue raisonné, where such claims related to or arise from our consideration of your artwork, our decision as to whether to include your artwork in the catalogue raisonné, and any subsequent change we may make with regard to our decision including the removal of the artwork from the catalogue raisonné.
